CONTRACT #20-B-5 (Re-Bid)

LIQUID OXYGEN

ADDENDUM NO. 3

The Bidding Documents for the referenced Contract are hereby amended by this addendum.  This addendum shall become part of the Contract.  Acknowledge receipt of this addendum, and previously issued Addenda Nos. 1 and 2, in the space provided on Page P-13 of the Bidding Documents.

Note that any and all verbal statements made at the pre-bid conference, or at any other times, if any, are of no force or effect.  Bidders shall base their Bids on the Bidding Documents as issued by the PVWC, including Addenda Nos. 1 through 3, and any and all other addenda, if any, that may be issued by PVWC.

Invitation to Bidders—Time Extension

The date and time for bid opening is hereby changed from Tuesday, June 2, 2020 at 2:00pm (as per Addendum #2) to Tuesday, June 9, 2020 at 2:00pm as per this Addendum #3.

Revision to § 0.33 entitled “Insurance” at page B-16. 

The following replaces § 0.33 entitled “Insurance” at page B-16:

0.33     INSURANCE

By submitted a Bid Submission to the Commission in response hereto, the Bidder agrees and certifies that they will fulfill all requirements relating to insurance coverages, including endorsements requested, and will fully adhere to the indemnification provisions in the Bidding Documents, if awarded the Contract.

Instructions for Filling out the End of the Form of Proposal.

The end of the Form of Proposal at P-4. beginning with “*** Indicate whether bidder is …”, mistakenly omits limited liability companies.  If the Bidder is a limited liability company, then indicate that you are a limited liability company and strike out the phrase “Corporation, State of Incorporation” on page P-4 of your Proposal for clarity.  Bidders which are limited liability companies do not have to submit a “Corporate Resolution”.

Revision to the Bid Document Submission Checklist.

The third item under part A of the Bid Document Submission Checklist on page P-14 is revised as follows:

The word “corporate” has been removed as it that word does not appear in the title of the actual form, which is found on pages P-6 to P-9.

Instructions for Filling out the Certification of Investment Activities in Iran.

The end of the Certification of Investment Activities in Iran on Page P-17 fails to have a separate signature line.  With respect to the line indicating “(Name and Title of Authorized Representative Signing this Certification)”, the person signing on the Bidder’s behalf shall print his/her name and title, and also provide his/her signature on or about that line of the form.

Revision to Section 11230 “Furnish and Delivery Liquid Oxygen (LOX)” Part 3 at 11230-5.

Part 3.C.3 of Specification Section 11230 entitled “Furnish and Delivery Liquid Oxygen (LOX)” is replaced with the following:

3.         The name and resume of the person(s) authorized to certify the laboratory report for the Contractor shall be submitted to, and approved by, the Commission prior to the first delivery of Product.

Revision to Section 11230 “Furnish and Delivery Liquid Oxygen (LOX)” Part 7 at 11230-9.

Part 7 of Specification Section 11230 entitled “Force Majeure” event is hereby deleted in its entirety.

Procurement General Conditions Rev. 2.

The Procurement General Conditions (the “PGC” pages of the Bidding Documents) are hereby replaced with Procurement General Conditions Rev. 2 (LOX Re-Bid), a copy of which are attached hereto.
